Terms and Conditions

These terms govern use of the Yakar website and the conditions applying to enquiries, quotations, supply, delivery, plant hire, and related services.

1. About These Terms

These Terms and Conditions apply when you visit or use this website, submit an enquiry, request or accept a quotation, purchase products, hire equipment, or engage Yakar Global Investment Holdings (Pty) Ltd for related services. Additional written terms in a quotation, order confirmation, hire agreement, or service agreement form part of the agreement and will apply to that transaction.

2. Website Use

This website provides information about Yakar's petroleum supply, lubricant solutions, yellow plant hire, and related project support services. You may use it for lawful purposes, to learn about our services, and to submit genuine enquiries.

You may not interfere with the website, attempt unauthorised access, submit malicious content, misrepresent your identity or authority, or use website content for unlawful or competing commercial purposes.

3. Enquiries and Quotations

Submitting an application or quote request does not create a binding supply agreement. Quotations are prepared by Yakar after reviewing the request details, location, volume, availability, pricing, delivery feasibility, and any operational requirements.

A quotation is valid until its stated expiry date and remains subject to stock or equipment availability, supplier pricing, transport capacity, site accessibility, and final operational confirmation. Unless a quotation states otherwise, prices are expressed in South African rand and VAT is added at the applicable rate.

An agreement is formed when Yakar receives the customer's acceptance and confirms the order, booking, or instruction in writing. A quotation reference or electronic communication may be used to identify and evidence the transaction.

4. Customer Information

When you submit an enquiry, Yakar may create or update a customer record for administrative purposes. This helps our team track applications, quotation history, customer communication, and fulfilment status.

5. Customer Responsibilities

You are responsible for providing accurate contact details, company information, delivery or site address, fuel type, quantity, equipment requirements, urgency, and compliance information. The person accepting a quotation on behalf of a business confirms that they have authority to do so.

The customer must ensure safe and lawful site access, suitable offloading or operating conditions, and the availability of authorised personnel to receive products or equipment. Incorrect or incomplete information may cause delays and additional costs.

6. Payment

Payment terms, deposits, credit arrangements, and due dates will be stated in the applicable quotation or agreement. Unless Yakar approves credit terms in writing, payment may be required before dispatch, delivery, mobilisation, or commencement of services. Overdue amounts may result in suspension of supply or services, subject to applicable law.

7. Delivery, Risk, and Delays

Delivery dates and times are estimates until confirmed in writing. Yakar will take reasonable steps to meet confirmed arrangements but is not responsible for delays outside its reasonable control, including supplier disruption, fuel shortages, transport interruption, severe weather, unsafe site conditions, regulatory restrictions, or events of force majeure.

Risk in products passes to the customer on delivery or offloading at the agreed location, unless the applicable quotation or written agreement states otherwise. The customer must inspect the delivery and promptly report any visible shortage, damage, or discrepancy.

8. Plant and Equipment Hire

Where equipment is hired, the customer must use it only for its intended purpose and in accordance with safety requirements, operating instructions, and any separate hire agreement. Responsibility for operators, fuel, security, damage, loss, breakdown reporting, collection, and return will be specified in the quotation or hire agreement.

9. Changes, Cancellation, and Refunds

Changes or cancellations must be requested in writing. Any cancellation fee or non-refundable cost will be reasonable and will take account of work already performed, products procured, transport arranged, equipment reserved, and other commitments made for the order. Refunds, where due, will be handled in accordance with the applicable agreement and South African law.

10. Service Availability

Yakar's services may depend on product availability, supplier conditions, transport capacity, site access, health and safety requirements, payment confirmation, and regional operational constraints. Website descriptions and indicative information may change without notice.

11. Intellectual Property

The Yakar name, website content, images, layout, service descriptions, and related material may not be copied, republished, or used for competing commercial purposes without written permission.

12. Warranties and Liability

While Yakar aims to keep the website accurate and available, website information is general and does not replace a formal quotation or written agreement. To the extent permitted by law, Yakar is not liable for indirect or consequential loss caused by website downtime, delayed or incomplete enquiries, third-party services, or circumstances outside its reasonable control.

Nothing in these Terms and Conditions excludes or limits any right, warranty, remedy, or liability that cannot lawfully be excluded or limited under applicable South African law.

13. Privacy and Electronic Communications

Personal information submitted through the website is handled in accordance with Yakar's Privacy Policy. You agree that enquiries, quotations, acceptances, notices, and supporting documents may be communicated electronically using the contact details you provide.

14. Governing Law

These Terms and Conditions and any transaction with Yakar are governed by the laws of the Republic of South Africa. The parties should first attempt to resolve a dispute through good-faith discussions before pursuing other remedies available under the applicable agreement or law.

15. Changes to These Terms

Yakar may update these Terms and Conditions when its services, processes, or legal obligations change. The version published on this page applies from its stated update date, while an accepted quotation or signed agreement remains governed by the terms applicable to that transaction unless the parties agree otherwise.
